Terms & Conditions The "Holl Pass" card of Holland College (herein referred to as the "Holl Pass") is governed by these terms and conditions and Holland College’s policies, procedures and regulations. Read the terms and conditions carefully as they constitute legal obligations between you and Holland College (the "College"). The use of the words "you" and "your" denote the person named on the Holl Pass. By obtaining a Holl Pass, depositing funds into your Holl Pass account or by using Holl Pass services, you agree to and accept all of these terms and conditions. The terms and conditions are subject to change from time to time and without notice. Future changes will apply to all Holl Passes in circulation and will supersede the previous terms and conditions in effect at the time you acquired your Holl Pass. Be sure to review the terms and conditions regularly.
1. Use and Ownership The Holl Pass and the photo are the property of Holland College. They are used by College faculties, services, and staff to identify you as a Holland College student and provide with you access to various services. You must present your Holl Pass upon request by the College or its service providers. The Holl Pass is entrusted to you, so you have access to the multitude of services available to you with the card. Please refer to the Use page of the Holl Pass website.
You are the only person entitled to use your card. The Holl Pass is non-transferable. You may not use your Holl Pass for any illegal, improper, or unlawful purpose, for example, presenting your Holl Pass as evidence of being a student at the College while not registered as a student. Using another student’s Holl Pass, or altering, falsifying, or selling a Holl Pass is prohibited and subject to sanctions, pursuant to the College’s regulations, policies and procedures (for example, Board Regulation 50-01-2 Student Code of Conduct and Administrative Regulations 50-0202 Student Attendance, Progress, Discipline and Appeals), and may also be subject to civil or criminal proceedings.
You may use your Holl Pass as a debit card where accepted by College service providers, provided funds are available in your account. The Holl Pass functions under the principle of a declining balance where purchases made with the Holl Pass will be deducted from your Holl Pass account balance. The purchase of alcohol, cigarettes, or lottery tickets is prohibited. The Holl Pass does not provide credit. Cash-back transactions are not permitted. The College reserves the right to deduct any outstanding balance on your student account from any refund of Holl Pass funds you may receive.
The Holl Pass has a Flex account. You Holl Pass Flex account is where your photocopying, printing, food service, vending machine and Samuel’s Campus Store purchases are taken from. You can view your online Holl Pass statement at any time by logging into your account.
You are responsible for use of your Holl Pass, including debits made as a result of misuse of your Holl Pass. If you have problems with anything you purchase using your Holl Pass, you must first try to settle the problem directly with the service provider. In some circumstances, the College may be able to provide assistance in resolving disputed or declined transactions (see section 6).
2. Security You are responsible for safeguarding your Holl Pass against loss or theft, for maintaining it in proper working condition and for keeping your online account password, or PIN, confidential. The College will never ask you to divulge any of your access information. If you suspect another person knows your PIN or password, change it immediately by signing into your account here or call the Holl Pass Office at (902) 566-9611.
3. Lost or Stolen Holl Pass If your Holl Pass is lost or stolen, you must immediately deactivate it. You can do this online, in person, by email or by calling the Holl Pass Office (902) 566-9611 during office hours. An email or voice message does not constitute proper notification for lost or stolen cards. A replacement fee of $20 (LINC students pay $10) is charged for all replacement cards. Your account will be reactivated only after the replacement fee is paid, your student status has been verified and a new Holl Pass has been issued.
You are responsible for all transactions until your Holl Pass is reported lost or stolen. The College is not responsible for funds or services obtained using a lost or stolen card. You will not be responsible for unauthorized use from transactions occurring after you deactivate your Holl Pass. Once a replacement Holl Pass has been issued, your remaining cash balance will be transferred to your new Holl Pass. After a Holl Pass is deactivated, it can only be reactivated at the Holl Pass Office with proof of identification, and only if a replacement card has not been issued. Once a new Holl Pass is issued, any previous Holl Passes are permanently deactivated.
If your Holl Pass is found and returned to the College, the Holl Pass Office will contact you.
4. Expired Holl Pass All student Holl Passes expire the month shown on the front of the Holl Pass. If you continue to attend Holland College beyond this expiry date, you must request a new card (no cost, except for LINC students, who pay $10). To request a replacement Holl Pass, log into SAM and go to Holl Pass Request Forms.
5. Charge Disputes If you are not able to successfully resolve a purchase disagreement with a service provider and you wish to dispute the charge deducted from your Holl Pass account, you must notify the Holl Pass Office within 30 calendar days of the date of the charge. You must provide the date, location, and amount of the transaction, along with any other information that may help staff resolve your claim. Disputing a charge does not necessarily guarantee that the disputed charge will be credited to your Holl Pass account Charge disputes are dealt with on a case-by case basis.
6. Currency All Holl Pass account funds are in Canadian dollars. Cash deposited in your card account at the Holl Pass Office must be in Canadian funds. All deposits made from a debit or credit card outside Canada may not be equivalent to the exact amount deposited due to currency exchange rates.
7. Refusal to Accept or Honor a Holl Pass as Payment The College is not responsible for refusal by a Holl Pass service provider to accept or honor your Holl Pass for whatever reason, including:
8. Refunds Flex Account: Refund of a remaining balance on your Holl Pass is available on contact with the Holl Pass Office. A $25 administration fee will be taken from this amount and a cheque will be processed and sent to the Holl Pass holder only for the remainder. The College reserves the right to deduct any outstanding balance on your student account from your refund. Please note that a refund could take up to three weeks. To request a refund, log into SAM and go to Holl Pass Request Forms.
9. Residual Fund If your Holl Pass remains inactive for a period of one year following the Holl Pass expiry date, all funds remaining on your Holl Pass accounts will become property of the College and will no longer be available to you.
10. Confiscation of Holl Pass A College employee or any Holl Pass service provider may confiscate your Holl Pass if you use it fraudulently, without authorization or for improper purposes. Once a Holl Pass is confiscated, it will be sent to the Holl Pass Office. A decision on sanctions will be made on a case-by-case basis. If your Holl Pass is confiscated, you will be required to use another payment method to complete a transaction.
11. Offline Transactions If the Holl Pass transaction reader is operating in offline mode, a limited number of transactions may be accepted. In such cases, transactions will be processed on your Holl Pass account once the reader is back online. You are responsible for all transactions made while the transaction reader is offline. If the declining balance on your card goes into a negative balance, you must bring the balance to zero by reloading your Holl Pass before you can use the card again.
12. Collection and Use of your Personal Information Your personal information is collected by the College in accordance with the College’s Privacy Policy and is intended to be used to verify your identity, to operate your Holl Pass through payment card networks and for the purpose of providing the services associated with the Holl Pass, in addition to administering College programs and activities and carrying out other College services and functions without limiting the general interpretation of the previous sentence.
Your digital photograph will be printed on the front of your Holl Pass and will be stored in the College database. All photos used for the Holl Pass, including those submitted by you, are Holland College property and may be shared with College faculties, services, staff and Holl Pass service providers to identify you as a student at Holland College.
Third parties will not be provided with information about you, your account or the purchases you make without your express consent, unless such disclosure of your personal information and photograph is required by law or to comply with a court order or legislation.
Questions regarding the collection and use of your personal information for the Holl Pass should be addressed to the Holl Pass Office. Questions of a general nature regarding the collection, use or disclosure of information by the College should be addressed to the College’s Chief Privacy Officer who may be contacted by email at privacy@hollandcollege.com or written to at Holland College Privacy Office, 140 Weymouth Street, Charlottetown, PE C1A 4Z1.
13. Limitations on the College’s Liability and Indemnity The College is not liable to you for any loss, inconvenience to you or to others or for any damages (including special, indirect or consequential) or expenses of any kind that may result from the use or misuse of the Holl Pass or if, for whatever reason, your Holl Pass is not accepted, or you do not have sufficient funds in your account. You agree to indemnify, hold harmless and release Holland College from any and all claims for losses, damages, injury, fees, expenses, charges or debts made by any party against the College arising out of the use or misuse of the Holl Pass, including any Meal Plan claims related to tax benefits and tax savings.
14. Meal Plans Meal Plans are a pre-paid service available on a semester or monthly basis, valid throughout the academic year. The Meal Plan service is not provided on weekends, during the December holiday period, March break, and any other dates where the College is closed. Meal Plans are available only at specific food areas as designated from time to time by Holland College Ancillary Services. Meal plans are not being offered until further notice.
14.1 Use of your Holl Pass Once your Meal Plan payment has been confirmed, funds are available on your Holl Pass. The Holl Pass is the sole method of payment accepted for meals purchased under a Meal Plan. If you do not present your Holl Pass to pay for your purchase, you must use another form of payment. If you forget, lose or deactivate your Holl Pass, you will be required to use another payment method until you obtain a replacement Holl Pass from the Holl Pass Office. A replacement fee of $20 applies. All meal purchases are final once the transaction is approved. If you did not use your Holl Pass to purchase a meal (including in the case of a lost or stolen card) and you use another payment method, the amount of the payment cannot be applied to your Meal Plan.
14.2 Meal Plans are Transferable Due to a change in federal tax savings measures, Meal Plan balances can be carried over for another year or transferred into a taxable Flex spending account for an administration fee of $25.
The Canada Revenue Agency requires that you spend at least $1000 per semester. If you do not meet the $1000 threshold, you are required to pay back the amount saved on tax. For example, if you only spend $800, you must pay back taxes on this used amount.
The tax-exempt portion of your Meal Plan may be transferred to your Flex account upon the payment of the exempted taxes on the used portion of your Meal Plan, the administration fee of $25 and provided that the transfer complies with regulations from Canada Revenue Agency governing the tax savings program for Meal Plans at colleges/universities.

14.4 Flex Account Your Flex account must be used to purchase items on campus that cannot be purchased with a Meal Plan. If you do not have funds in your Flex account, you must use another payment method. The list below contains examples of items (subject to change) that cannot be purchased with a Meal Plan:
